Nelson Airport Limited (NAL) owns and operates Nelson Airport and provides designated parking areas (Public Parking Areas) for the general public at Nelson Airport. Except by prior arrangement, use of Public Parking Areas is subject to time-based charges payable immediately prior to exiting Nelson Airport.

Targeted towards high-frequency non-commercial users, NAL offers a Public Carpark Pass that allows holders unlimited use of Nelson Airport’s Public Parking Areas by up to two registered vehicles on a ‘single vehicle at a time’ basis for a licence fee payable in advance.

Establishment of Licence

1.        Upon confirmation of acceptance by Nelson Airport Ltd (NAL):

a.      The Applicant will be the Licensee, and

b.      This application form will constitute the Nelson Airport Public Carpark Pass licence agreement (Licence).

2.        Signing and dating this application will confirm NAL’s acceptance.

3.        The Commencement Date for the Licence shall be date at which NAL confirms to the Licensee via email of the Licence Fee and that the Licence has been setup in NAL’s system.

4.        The Licence will not be activated in NAL’s system (and available for use by the Licensee) until the Licence Fee has been paid in full by electronic payment to the bank account nominated by NAL.

5.        At the Licensee’s discretion, the definition of the Licensee may be extended to include the Licensee’s spouse or partner and dependents living with the Licensee.

6.       The Licence is personal to the Licensee and is not assignable.

Use of Carparks

7.        Under this Licence, and with the exception of how usage charges are applied, and carpark access controls are activated, the Licensee is permitted to use Nelson Airport’s Public Parking Areas on the same terms and conditions as apply to the general public.

8.        Under normal circumstances NAL’s licence plate recognition system will detect the Licensee’s vehicle(s) and automatically activate Public Parking Area access controls.

9.        Where NAL’s licence plate recognition system fails to detect the Licensee’s vehicle, the Licensee will need to utilise the call button on the access control column to alert NAL’s customer service team, who will then resolve activation.

10.     Only vehicles having vehicle registration details recorded in this Licence may be used by the Licensee pursuant to this Licence.

11.     Notwithstanding this Licence may list up to two vehicle registrations, the Licensee may only have one vehicle at a time within the Public Parking Areas pursuant to this Licence.

12.     The Licensee may update the vehicle registration details associated with this Licence from time to time as required by providing written notice to NAL.

13.     This Licence is on a space available basis and NAL gives no warranty that a parking space will be available at all times to the Licensee.

14.     In the event that no parking space is available in Public Parking Areas, NAL will use reasonable endeavours to offer alternative space.

15.     The Licensee shall have no claim against NAL should all parking spaces be occupied by other carpark users.

16.     No Commercial Use. This Licence does not permit Commercial Use of Nelson Airport’s Public Parking Areas.  Commercial Use refers to provision of road-based transport to or from Nelson Airport as part of a commercial undertaking.  By way of non-exhaustive examples, Commercial Use includes activities like transportation of customers associated with accommodation businesses, tourism activities, vehicle hire businesses and transportation for reward.

For clarity, if the Licensee wishes to conduct activities of a Commercial Use nature at Nelson Airport, the Licensee must secure an appropriate separate licence for that activity.

Fees and Costs

17.     The Licence Fee must be paid in full before NAL will activate the Licence in NAL’s system.

18.     Except for the Licence Fee, the Licensee must pay in full invoices issued by NAL under this Licence on or before the 20th of the month following the date of invoice.

19.     NAL may recover from the Licensee any reasonable costs incurred by NAL to repair or replace property damaged as a result of the Licensee’s use of NAL’s facilities.

20.     NAL may recover from the Licensee any reasonable cost incurred by NAL in enforcing its rights under this Licence including any costs incurred in collecting invoiced amounts.

21.    NAL’s rights with respect to fees and costs shall survive expiry or termination of this Licence.

Management of Airport

22.     Nothing in this Licence shall fetter NAL’s ability to manage, adapt, and respond to the operational needs of the airport.

23.    NAL may temporarily or permanently close, repurpose, and realign airport roads and Public Parking Areas.

Term and Termination of Licence

24.     Unless terminated, this Licence shall expire on the 30th of June following the Commencement Date.

25.     NAL may terminate this Licence upon notice to the Licensee for any breach of this Licence by the Licensee.
